Water Contractor Licensing Requirements and Compliance
Any person, firm, corporation, or other legal entity seeking to perform work in connection with, relating to, or affecting, the Sudbury Water District public drinking water system, including but not limited to, domestic and fire trench excavation, water main or service pipe installation, repair, alteration, or disconnection on both public and private ways and parcels must hold an active Water Contractor license authorized and issued by the Sudbury Water District.
Such persons, firms, corporations, or other legal entities shall strictly comply with the Federal Safe Drinking Water Act, 42 U.S.C. § 300f et seq.; the Massachusetts Drinking Water Regulations, 310 CMR 22.00, as administered by the Massachusetts Department of Environmental Protection (MassDEP); the Sudbury Water District System Rules and Regulations; and all other applicable federal, state, and local laws, bylaws, ordinances, rules, regulations, policies, technical standards, specifications, rates, and fees of the Sudbury Water District.

Independent Municipal Authority
The Sudbury Water District (hereinafter, the “District”) is an independent municipal entity established under an Act of the Massachusetts Legislature in 1934. The District operates as a separate and autonomous public body and is not, in any manner, affiliated with, subject to, or governed by the Town of Sudbury or its municipal departments.
As provided in Massachusetts General Laws, Chapter 41, Section 69B, all authority and jurisdiction, including but not limited to protection, permitting, regulation, and enforcement, in connection with, relating to, or affecting the District’s public drinking water system are vested solely and exclusively in the Board of Water Commissioners. The Board of Water Commissioners retain full authority to enforce compliance with these provisions through all remedies available under applicable law, including, without limitation, fines, penalties, corrective orders, and other legal or equitable relief.
Accordingly, any instrument, filing, or submission, including but not limited to applications, forms, payments, certificates, licenses, bonds, bids, and proposals, shall be solely and explicitly addressed to, filed with, and issued in the name of the Sudbury Water District.
Any such submission addressed in the name of any municipal body other than the Sudbury Water District (e.g., the Town of Sudbury or its Department of Public Works) shall be deemed invalid and may be rejected without review, evaluation, or consideration, regardless of intent, error, or circumstance.
Licensing Terms and Conditions
By signing and submitting a completed Water Contractor License Application, the applicant:
- Certifies that all information is true and accurate;
- Agrees to comply with all applicable laws, rules, regulations, policies, technical specifications, rates and fees established by the Sudbury Water Distict.
- Agrees to indemnify, defend, and hold harmless the District, its Commissioners, officers, employees, and agents from all claims, liabilities, damages, losses, costs, and expenses arising from or relating to the work performed;
- Acknowledges that a Water Contractor license does not replace project-specific permits (e.g., duly authorized and approved GWPA), and;
The Sudbury Water District reserves the right to suspend or revoke any license for cause, including without limitation:
- Operating with a suspended or expired MA Hoisting Engineer license;
- Engagement in unsafe or improper construction practices;
- Submission of false or misleading information;
- Failure to maintain required insurance or bonds, or
- Negligent violation of the Sudbury Water District system rules, regulations and policies.

General Water Permit Application (GWPA) Requirements:
Required Submittals and Fees
A signed and completed GWPA together with supporting documentation (as required, per project), is required at the time of payment, in One (1) Single-Complete-Package.
Applications submitted piecemail, or with missing or incomplete information will be rejected.
Authorization of Water Utility Work
No person, firm, corporation, or other legal entity shall commence, perform, or engage in any water utility work in connection with, or affecting, the Sudbury Water District public drinking water system unless and until express prior written authorization has been issued by the District in the form of a duly approved and executed GWPA bearing the signature of the District Foreman or a duly authorized agent of the District.
Compliance
Any water utility work performed, or engaged in without prior written authorization, as set forth herein, shall constitute a direct violation of 310 CMR 22.00 (Massachusetts Drinking Water Regulations) and the Sudbury Water District System Rules and Regulations, and shall be subject to all enforcement actions, penalties, and remedies available under applicable law.
